Lisa Parkes Elemental Retreats - Terms & Conditions

I confirm and agree that the following terms and conditions and understandings apply to any activities to be provided to me by Lisa Parkes Elemental Retreats.
According to the licensed medical practitioner (“Practitioner”) which have examined myself within the past six months, I am able to perform movement activities including, but not limited to general exercising, yoga, breathwork, walking, swimming, massage (“Activities”), which I am to perform during Lisa Parkes Elemental Retreat.
I will faithfully follow all instructions given to me by Lisa Parkes and other facilitators, contractors or assistants as to when, where, and how to perform or not-to-perform the Activities.
I agree and acknowledge that participation in any of the Activities could constitute a risk of serious injury to myself, including permanent paralysis or death. I voluntarily and knowingly recognise, accept and assume this risk and warrant that I am physically fit and able to perform the Activities without risking serious injuries as described above. I acknowledge that neither Lisa Parkes herself or her employees, contractors, or assistants not to be deemed to be responsible or liable (whether in contract or in tort or under any statute whatsoever) for any injury, illness or other mishaps I sutain arising from or out of or any way directly or indirectly connected with the Activities.
I understand and acknowledge that I am to receive instruction and facilitation in Activities and that Lisa Parkes herself or her employees, contractors, or assistants are not liable for, nor expected to provide any advice, training or medical assistance other than what will be included in the Elemental Retreat Program.
I indemnify and will at all times hereafter well and sufficiently indemnify and keep fully indemnified Lisa Parkes, other facilitators, representatives or employees of Lisa Parkes from and against all actions, suits, causes of action, proceedings, claims, costs and expenses whatsoever which may be taken or made against Lisa Parkes or any of her representatives, incurred or become payable by Lisa Parkes or any of her representatives in connection with or arising out of any such injury, illness or mishap to me on retreat with Lisa Parkes Elemental Retreats.
We require full payment at time of booking. Any cancellations made within 14 days prior to arrival will incur 100% cancellation fee. If you need to cancel this booking the payment may be transferred to a future retreat date within 12 months. If transferring within a window of four weeks prior to the booked retreat a $300 admin fee (or $100 admin fee for day passes) will incur (please note retreat costs may increase in this transferable time in which case you will be required to pay the difference). No transfers are available within the two week window of the booked retreat, you will forfeit your spot on retreat and all monies paid to date.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I, or others, may be exposed to, or infected by COVID-19 while attending lisa parkes Elemental retreat activities or events, and that such exposure or infection may result in personal injury, illness, disability or death. I understand that in order to attend an elemental retreat activity or event I must be free from COVID-19 symptoms. Should symptoms develop while in the care of retreat, I will be separated from the rest of the people at the Retreat and must be picked up or depart immediately. I further voluntarily agree that I will immediately notify lisa Parkes elemental retreat staff if I become aware of any person with whom I have had contact exhibits any symptoms of COVID-19, is advised to self-isolate, quarantine, or has tested positive for COVID-19 prior to, during, or within two weeks after my participation in activities or events. I voluntarily agree to assume all of the foregoing risks, to accept sole responsibility for any injury from to myself or to any other person, including, but not limited to, personal injury, illness (including COVID-19), disability, death, damage, loss, claim, liability, or expense of any kind, that I or others may experience or incur in connection with, or participation in lisa parkes elemental retreat activities or events.
Lisa Parkes at all times up to and including the first day of the retreat has as its sole and unfettered discretion the choice to terminate this contract on the basis that not enough people or customers have booked or arrived at the retreat. Whether or not enough people/customers have attended any retreat will be decided by Lisa Parkes in her sole, absolute and unfettered discretion. If Lisa Parkes terminates this contract for the reasons outlined above then Lisa Parkes will offer a credit (to be used within 12 months) to the Customer equal to the amount of money paid by the Customer for it to spend on any service provided by Lisa Parkes.
